Liability Insurance Now Required for Daycare Providers

There's a new law in Oklahoma aimed at giving parents and caregivers more information when choosing the source of care for their children:

Governor Brad Henry signed legislation on Tuesday requiring day care providers to have liability insurance.

Demarion's Law would require all state child care facilities to maintain liability insurance of at least $200,000 for each occurrence of negligence.

The law was named after Demarion Pittman, a three-year-old boy who suffered severe brain injuries after his day care providers left him in a hot car for over an hour last summer. His medical bills have totaled nearly $2 million so far.

There are some exceptions for day cares that cannot afford it or are not approved for insurance. They can keep operating as long as they notify parents that they do not have insurance.

$200,000 is but a drop in the bucket as liability insurance goes, especially for the namesake's cause.

Yet, one could imagine that this new law, which takes effect on November 1st, will do two thing:

  • Empower parents to have more information available to them in picking daycare providers
  • Put pressure on less-than-scrupulous daycare providers to operate legally or lose the business

Now, parents absolutely must ask (and as Reagan said, "verify") the insurance status of anyone providing daycare for their children.

    The Texas bill that this one was patterned after requires $300,000.00. Are our kids worth less than Texas kids?
    The minimum limit should have been at least $1,000,000.00. Of course the cost will be past along to the customers in the form of higher rates.

    Which brings me to respond to the words posted By Sean Johnson on 04/23 regarding the Bill refused to be heard in the Ok House Committee. I agree with Rep. Peterson's position. We need to ascertain the increased insurance cost that such mandates will cause and the benefit to be realized by the coverage before passing such a bill. Right now, your health insurance cost 43% more becasue of previous mandates that have been added by the state. I am not saying that the coverage was not needed, it is just a concern as our cost of insurance premiums continues to rise unchecked. Verify before acting!

    It's amazing to me how careless parents can be in leaving their kids with virtual strangers as daycare. I swear it's like "ignorance is bliss" for these parents - they don't ask questions because they don't want to know all the bad things about their daycare

    I suppose parent could always decide to PARENT THEIR OWN KIDS rather then drop them off for storage during the day while they pursue wealth!
