Judge rejects request from OTA, ODOT to throw out lawsuit over tolls

ROGER COUNTY, Okla. — A Rogers County judge has rejected a request from the Oklahoma Turnpike Authority (OTA) and the Oklahoma Department of Transportation (ODOT) to throw out a lawsuit against them over tolls in a part of the Will Rogers Turnpike.

The ruling clears the way for discovery — meaning both sides can now exchnage evidence — after the judge said the lawsuit raises valid legal questions that can’t be decided yet.

We told you earlier that former state Senate Leader Stratton Taylor filed the class-action lawsuit claiming the OTA has been illegally collecting tolls on a stretch of Interstate 44 — from the Highway 412 interchange in Catoosa to Highway 20 south of Claremore for months.

The lawsuit argues a law passed in 2000 requires those tolls to be removed and seeks refunds for drivers who paid them.

Drivers pay 66 cents to travel the 10-mile stretch with a Pikepass or $2.10 using Plateplay.
