PAWNEE COUNTY, Okla. — The Oklahoma Attorney General’s Office will now be prosecuting the case against the Pawnee County Undersheriff.

Undersheriff Nick Mahoney is charged with felony embezzlement and false claims against the state after prosecutors say he used his county issued car to drive to and from his off-duty security job in Tulsa.

He’s also accused of getting paid for work during certain hours at the sheriff’s office while he was working the second job. Mahoney told FOX23 the sheriff gave him permission to use his car because he has to be available at all times to respond when needed in Pawnee County. He also says the pay issue was a clerical error by another person in their office.

Mahoney asked for the case to be sent to the Attorney General’s Office in order to get a more partial actor due to potential conflicts, according to court documents.

A preliminary hearing is scheduled for March.
