Company ordered to remove wind farm from Osage Nation land

An Italy-based wind farm company will have to remove more than 80 wind turbines from Osage Nation land, after a judge ruled the tower construction violates the tribe’s mineral rights.

The case has been making the rounds in various courts for the past 10 years.

The Osage Nation sued, alleging that the blasting and digging by Enel Green Power, to make the foundations for the towers, constituted mining.

An early court ruling said it was not.

But more recent rulings said it was, and were upheld by the Supreme Court.

Negotiations failed between the two sides, and a judge this week said the 84 turbines have to be removed by December 1, 2025.

Enel has estimated the removal will cost the company nearly $300 million.

The judge also ordered Enel to pay millions in legal fees to both the Osage Nation and the U.S. government.
