TULSA, Okla. — The Tulsa Police Department responded to a shooting call at an apartment complex on July 26. It happened Saturday morning at a complex near Admiral and Mingo.
According to police, Byron Penn, 41, allegedly stalked and threatened a woman and her boyfriend near a local nightclub the night before the shooting. The victims said that Penn told them he had been previously incarcerated for murder, and he was “not afraid of law enforcement.”
The victims said on July 26, Penn forced his way into their apartment. The victims told police they feared for their safety and the boyfriend fired at Penn.
Police arrived on the scene to discover Penn had been shot and was pronounced dead on scene.
Police received a full statement from the boyfriend, and he has been cooperating with the investigation, which is ongoing.
Tulsa Police said this marks Tulsa’s 31st homicide this year. They clarified that homicide is defined as “one human killing another human.”
“Homicide is not a chargeable offense like murder, manslaughter, etc.,” said TPD. “The DA will examine this case, and they may rule it a justifiable homicide.”
This is an ongoing investigation and will be presented to the Tulsa County District Attorney once completed to determine if charges are warranted.
