Mother files federal lawsuit after son attacked by teaching assistant

TULSA, Okla. — A Tulsa mother has filed a federal lawsuit after her seven-year-old son was attacked by a teaching assistant at a Tulsa Public School elementary campus in February 2024.

The complaint alleges the assistant, Nicholas Stowell, dragged and slammed the child on the playground and that the district failed to notify the family, provide care, or accommodate the student’s disabilities as required under federal law.

The lawsuit claims violations of the Americans with Disabilities Act, among others and seeks unspecified damages to hold the district and Stowell accountable for the attack and its aftermath.

In August 2024, Stowell waived his right to a jury trial and pleaded guilty to one count of child abuse. He was sentenced to a 6-year differed sentence.
