TULSA, Okla. — Tulsa police arrested a man accused of pointing a BB gun at another man and demanding cigarettes on Monday night.

Police said the victim was walking to his car in a parking lot when a man approached him, holding a gun wrapped in a cloth. Investigators said the suspect pointed the weapon at the victim and demanded cigarettes.

The victim ran back inside the store and called 911, believing the weapon was a real firearm.

Officers arrived and contacted the suspect, who police said was holding the handle of a pistol. After the suspect refused repeated commands, officers deployed pepper balls before the man eventually got on the ground and was taken into custody. Police later determined the weapon was a BB gun.

TPD said the suspect was still arrested because Oklahoma law does not require the weapon to be a functioning firearm for a person to be charged with feloniously pointing a firearm.

According to police, the suspect was booked into the Tulsa County jail on complaints of first-degree robbery and feloniously pointing a firearm.
